You think that everything what you told you our adc friend is true. But it is not.
OpenSSL is GNU GPL incompatible, that is fact http://www.gnu.org/philosophy/license-l ... leLicenses
They use code that they can't because his licence don't allow compile with OpenSSL. I'm told them that and they have more than year to fix that but they don't.
They don't give me another choice, so today was on sourceforge blocked public access to strongdc. That was first...

Yes, of course... you are partially right, but there are some other things:

1) RecentFrame is only a pure copy of FavoriteFrame with some code removed. FavoriteFrame is copyrighted by Jacek Sieka, so derived work (RecentFrame) has same copyright. You said

but it's not true at all. I've downloaded CZDC++ 0.305A and it's not there. It has been implemented in some 0.306 in time when StrongDC++ was already developed.

2) WaitingUserFrame/UploadQueueFrame has originally been made by cologic. So any other use (also rewrite, except completely new work) is only its derivation and therefore you are not copyright holder.

3) The last thing, if you want to deny points 1 and 2. It looks that you are very smart, but not enough. There are many links in google to your CZDC 0.699B2 from 28th February 2008. Its license says:

This program is licensed under GPL-2 with the notable exception
that you may compile it with WTL (sf.net/projects/wtl) and OpenSSL (http://www.openssl.org).

Yes, such license isn't included in package on your website. However, the package is dated 28th February 2008, almost all files in it have the same date. Original license file has the same date. Only file on your website has completely different date. So it's just pure proof that you've changed the license file in last time. So, even you are real copyright holder of any code in StrongDC++, this code was copied under license which was included with source code.

4) Ah, and the last thing... if you love copyright, licenses etc. so much, I have your filelist and we could see who violates copyrights :lol:

If there is any problem at the moment it is with the fact that the DC++ Licence.txt does not contain an exception for WTL (http://bazaar.launchpad.net/~dcplusplus ... icense.txt). This exception was removed in October 2007, when OpenSSL was added as an exception (http://bazaar.launchpad.net/~dcplusplus ... icense.txt).

However, the copyright holder (Jacek Sieka aka arnetheduck) is free to grant additional exceptions on a case-by-case basis. If he is happy with the use of WTL in ApexDC++, StrongDC++ and RSX++, then there is nothing to worry about for code that derives from DC++.

As for any code taken from other mods, copyright lies with the original author of each piece of code. To modify a function is not enough to create a new work, it must be substantially different in form and function e.g. translating to a different language does not create a new work, nor does moving to a different base class library. The burden of proof lies with the claimant in most jurisdictions, thus the claimant must prove that they are the original author of the code. If the defendant produces an earlier work containing substantially similar code for the function in question, then the claim is invalid.

And anyway, who really cares that much? It's open source, it's for the community... who cares?

I was already talking about this with arne some time ago. It seems he has no problem with compiling StrongDC++ with WTL and he told me that he will add wtl back to the list of exceptions.
